August 1 Marks Key Updates to Unemployment Reporting in Louisiana

Effective August 1, 2025, updates in Louisiana's unemployment compensation system will be implemented to align with the outcome of recent legislation. Governor Landry has signed into law amendments to R.S. 23:1541(A) and 1576, aimed at enhancing employer contributions, managing the social charge account, and refining the unemployment benefit charges.
Key Changes Include:
- Employer Contribution Notifications: The administrator will now provide detailed statements to employers within 90 days of each calendar quarter, outlining benefits paid to individuals and charged against their experience-rating records. Employers have a 30-day window to contest these charges by submitting an application for review, citing specific reasons.
- Exclusions for Executive Orders Benefits: Benefits paid to employees of experience-rated employers under certain Executive Orders will not be recorded on employers' experience-rating records.
- Updated Requirements for the LWC-77 Separation Notice:
Effective August 1, 2025, Louisiana employers will see changes to the process for submitting the LWC-77 Separation Notice form. While there was some initial confusion, employers should be aware that the form is still required for all employee separations, regardless of the reason.
The law extends the deadline to submit the form—from the current three (3) days to ten (10) days following the employee’s separation date. Additionally, employers will now be required to submit the form electronically to the Louisiana Workforce Commission; physical mail, hand delivery, or fax will no longer be accepted. Employers must also continue to provide a copy of the completed form to the separated employee. In summary, the LWC-77 remains a mandatory part of the separation process, but with an extended deadline and new electronic submission requirement beginning in August.
